User License Terms

Feedback from our clients stating they need to share the publications with their colleagues and edit the content where applicable, has prompted the development of a range of user licenses which provide more flexible copyright options.

To select the appropriate User License Type, simply consider your potential use of the publications and decide:

1. Access: How many people will need (or like) access to the publication?

2. Format: Do you need to edit the content for:

a) Customisation before implementation eg. Spa Operations Manuals, or

b) Extract of data eg. survey results for internal reports and presentations.

Most clients share our publications with their colleagues, so the default license selected is "Site License"

Enterprise License
Summary:	Multiple spas and/or office locations.
Description:	Any number of employees of the same company, including employees of subsidiaries where the registered purchasing company owns at least 50% share in the subsidiary, spread across multiple geographic locations, offices or properties may share the publication, including via an intranet server (PDF version only) provided access is strictly limited to direct employees of the company. Information contained in Intelligent Spas' publications may not be presented/quoted externally, including but not limited to, at conferences, seminars, industry events and training programs, without written permission from Intelligent Spas.
Access:	All employees across multiple locations of same company may view the publication.
Format:	Editable Microsoft Word File AND Secure PDF File.
Example:	To share with employees of XYZ Spa in Bangkok, XYZ Spa in Phuket and XYZ Spa in London.
Value:	The copyright is unlimited within your company across multiple locations offering excellent value to brands/chains.

Site License
Summary:	One spa or office location.
Description:	Any number of employees of the same company, located in the same geographical location, office or property may use the publication. Information contained in Intelligent Spas' publications may not be presented/quoted externally, including but not limited to, at conferences, seminars, industry events and training programs, without written permission from Intelligent Spas.
Access:	All employees in one location may view the publication.
Format:	Editable Microsoft Word File AND Secure PDF File.
Example:	To share with all employees of XYZ Spa in Bangkok.
Value:	This license is unlimited within one office or property location, offering great value where multiple employees require access to eg. your new Spa Operating Procedures, Policies and Forms Manuals for training and implementation.

Consultant License
Summary:	Use by registered consulting firms for offering consulting services to clients.
Description:	Publications may be used for multiple, commissioned/paid client consulting engagements and related client deliverables may be generated based on information contained in the Intelligent Spas' publications. NOTES: - The original Intelligent Spas' publications may NOT be given to, or shared with, consultants' clients. If consultants' clients require access to Intelligent Spas' original publications, they must purchase their own appropriate user license. - Consultants must deliver customised, ready-to-implement versions of the Spa Operations Manuals to clients, sold as a consulting service at a price which includes appropriate consulting time to effectively customise the manuals for the client. - The original and/or customised publications may not be sold as retail items with no or minimal customisation, and may not be priced individually. - The publications may not be used in the preparation of studies/reports which will be sold or otherwise distributed. Contact Intelligent Spas to discuss a 'Custom License Agreement' if this is required. - Information contained in Intelligent Spas' publications may not be presented/quoted externally, including but not limited to, at conferences, seminars, industry events and training programs, without written permission from Intelligent Spas.
Access:	All employees in ONE consulting firm LOCATION may view the publication and use for multiple client engagements. NOTE: If the consulting firm needs to use the publications in multiple locations/offices, please contact Intelligent Spas to request a 'Custom License Agreement' to address your specific requirements.
Format:	Editable Microsoft Word File AND Secure PDF File.
Value:	Multiple employees within one consultant office may view the publications and the number of client studies you may use the publications for is not limited.

Library License
Summary:	Use in public or academic libraries.
Description:	This library license is available to public libraries or academic libraries of recognised educational institutions. Three (3) copies of each publication purchased may be printed and made available to library members and the PDF publication files may be placed on the Library's intranet server provided access is strictly limited to library employees and members only. Information contained in Intelligent Spas' publications may not be presented/quoted externally, including but not limited to, at conferences, seminars, industry events and training programs, without written permission from Intelligent Spas.
Access:	All employees and members of one academic or public library location may view the publication.
Format:	Secure PDF File.
Value:	There is no limit to the number of library employees and members who may access the publications.

Student License
Summary:	One full-time student only, not employed.
Description:	Publications may be purchased and used by a full-time student for non-commercial purposes only, and may NOT be shared with, or used by, anyone other than the student who purchases the publication. To qualify for a student discount, you MUST send a fax or scanned copy of your valid, full-time Student Photo Identification Card to Intelligent Spas within seven (7) days of purchase. The publications will not be accessible until identification is received. Refer to your receipt for our contact page for fax number and scanned file upload details. Information contained in Intelligent Spas' publications may not be presented/quoted externally, including but not limited to, at conferences, seminars, industry events and training programs, without written permission from Intelligent Spas.
Access:	Full-time students requiring publications for non-commercial purposes may view the publication. DO NOT SELECT 'STUDENT LICENSE' IF YOU ARE NOT A FULL TIME STUDENT. DO NOT SELECT 'STUDENT LICENSE' IF YOU ARE EMPLOYED. Students must submit a valid and current Full Time Student Identification Card to complete the order. Student Licenses are for the sole use of the purchaser for student purposes only. Publications will not be released until sufficient identification is provided. Intelligent Spas reserves to right to undertake additional activities to confirm the purchaser is a full time student and is not employed by or representing any company in any way. Students must not make a purchase for someone else to use the publication(s). If the purchaser cannot prove they are a full time student, they will forfeit the payment to cover administration fees incurred during the investigation. Student Licenses must not to be purchased and used for commercial use.
Format:	Secure PDF File.
Value:	This license is discounted to support full-time students' educational requirements.

Period of Licenses and Upgrade Options

The User Licenses do not have expiry dates however where the purchaser's use of the publications changes, an upgrade to the most relevant License Type may be purchased to ensure the purchaser continues to abide by the User Licenses Terms.

For example, if you initially purchase a Site License and in the future you require the content from Intelligent Spas' publication(s) for additional spa branches or offices, you may upgrade to an Enterprise License to enable the publication(s) to be distributed to colleagues in additional spa/office locations.

Delivery of the Publications

The publications are only available in electronic format as this minimises prices by eliminating printing, postage and delivery charges. This process also enables immediate delivery so you may begin to use the information immediately after you pay for it. Each publication is available in secure PDF format and some User License Types include editable Microsoft Word files for convenient customisation or extraction of the information. You may save the publications files onto your computer and print them for easy reading.

Customisation of Publications

The Enterprise, Site and Consultant Licenses provide the Microsoft Word files which allow the purchaser to make changes to the original content and customise for their specific needs. The purchaser may extract the content into their preferred format. Use of any customised version(s) based on, or using content from, Intelligent Spas' original publications must also comply with the User License Terms.

Quotes from Publications

No part of the publications may be quoted externally, including in conference presentations, without written permission from Intelligent Spas.

a) Student Licenses:

If a small selection of information is required to support individual student project activities the registered purchaser is granted permission to quote up to fifteen individual statistics from the purchased publication without written permission from Intelligent Spas Pte Ltd, provided they source and state 'Intelligent Spas' plus the official name of the publication at each occurrence, including written or verbal communications. If more than fifteen individual statistics are required, the purchaser is required to upgrade to another appropriate User License or send a written request via Intelligent Spas' Online Contact Form.

b) Other User Licenses:

Registered purchases of other User Licenses may use the contents of this publication for internal reporting activities such as feasibility studies, business plans, company reports and presentations according to the terms of their User License, without written permission from Intelligent Spas Pte Ltd, provided they source and state 'Intelligent Spas' plus the official name of the publication at each occurrence, including written or verbal communications.

Refund Policy

As the publications are delivered in electronic format, a refund is not available. Downgrades to other User License Types are not possible. To assist the decision to purchase, Intelligent Spas' web site www.IntelligentSpas.com provides a range of information including:

User License Agreement and Legal Liability

By purchasing publications from Intelligent Spas via the Online Store, Fax Order Form or any other method, you agree to abide by Intelligent Spas' Terms of Business and User License Terms including but not limited to the Copyright associated with the User Licenses. The copyright and security of publications purchased from Intelligent Spas including both electronic and printed copies are the responsibility of the registered purchaser. Legal action will be taken to recover all revenue lost and related expenses incurred as a result of breach of copyright and/or other User License Terms. Terms are subject to change without notice. This User License Agreement shall be governed by and construed and interpreted in accordance with the laws of the Republic of Singapore, and the purchaser agrees that all matters arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Republic of Singapore. The prevailing party in any action to enforce this agreement shall be entitled to reasonable costs and legal fees.
